In-N-Out Sends SF Brewery A Very Friendly ‘Cease And Desist’ Letter

In-N-Out Burger has sent a cease and desist order to a Bay Area brewery because its In-N-Stout has a strong brand resemblance to the popular burger chain. The branding of the beer looks an awful lot like the branding of In-N-Out, which is not sitting well with them. In-N-Out was quick to respond, sending a very friendly C&D basically the next day. The letter read, “Based on your use of our marks, we felt obligated to hop to action in order to prevent further issues from brewing. ‘We hope you appreciate, however, that we are attempting to clearly distill our rights by crafting an amicable approach with you, rather than barrel through this.”

This is not the first time Seven Still has received a C&D. They got one from Makers Mark, but surprisingly not (yet) for one of its label that looks very similar to the Swedish Fish candy wrapper. The company says this is all part of its marketing strategy in a crowded field of breweries
